No Fate but What We Make. 那個時候,醫院的器官移植手術正處於啓蒙的階段,因為不熟悉有可能會增加犯錯的機會,而醫療最不容許的就是失誤,每一次的失誤,病人往往以生命付出代價,為了避免這種機會,所以各個環節都要有專門的人負責,我在那個時空環境背景下,成為專屬麻醉醫師,當時在那個醫療資源相對匱乏的年代,全院只有一位外科醫師,具有資格作移植手術,所以那個時候,移植手術是這樣作的. 外科加護病房家屬探視的時間一天只有兩次,分別是早上跟傍晚,家屬經過器官勸募後,經過一整夜的思考,一般會在早上見過患者最後一面後,同意作器官捐贈,所以我們會在早上為病患進行第一次腦死宣判,每一次的腦死宣判必須間隔4小時,器捐的患者一般必須經過兩次腦死宣判,所以確定患者腦死時一般都已經傍晚了,患者腦死之後,器官會跟著慢慢衰竭,為了確保移植手術的成功率,所以要越快取下器官越好,取下的器官則要越早移植到病患身上越好,所以 等到各方人馬到期,準備妥當,開始手術之時,往往是夜色最深的時刻,所以每一次的器官移植手術其實意味著 今晚徹夜未眠. 然後再爬起來,繼續看著螢幕上病人的生理數據, 餓了也不吃飯. 儘管已經費盡心思,在每...

Http:/ tw.nextmedia.com/applenews/article/art id/33713780/IssueID/20111004. 筆者強烈認為 醫療糾紛的去 刑法 化有其必要性. 判刑之目的在使當事人悔改自新，醫療糾紛案件有滿足此法理學條件嗎 醫療糾紛是因醫師疏忽未注意造成， 以救人為天職的醫師，根本不是故意或惡意要加害病患，又何來擾亂社會秩序之虞呢 難道因醫療糾紛將醫師判徒刑後，社會秩序會改善嗎. 但現在專科醫師及醫藥分業制度已上軌道為何還要讓醫療糾紛保留刑事責任 又有一說是保留刑事責任是要以 刑法 逼 民法 ，使受害的病患易於得到賠償，這根本違反當初法律設計將 民法 和 刑法 分軌的法理學原則。 另有人認為若貨車司機撞死人，也要負起業務過失致死罪，受 刑法 的追訴，而法律之前人人平等，為何醫護人員可免除 刑法 兩者最大不同點在於動機，醫師是為了救人而去診治病患而貨車司機則不然. 但根據英國 經濟學人 雜誌的調查，台灣是世界健康排名第二的國家， 為台灣民眾打拼造就台灣之光的醫護人員，竟成為世界第一的罪犯，這是多大的諷刺.
