Wednesday, June 15, 2011. 律師（或法律人）都在狡辯嗎？很多人會說「是」。箇中原因在於一般人對法學有瑰麗的期待，認為受過法學教育的人，可以經過一番努力，找出任何法律問題最終的答案。既然如此，對造雙方律師各執一詞，顯然至少有一方在狡辯。 然而，關鍵問題在於每個法律問題是否都只有「一個」最終答案。抱持肯定想法進入法律系的新鮮人，最大的衝擊莫過於發現每個法律問題都有好幾個候選答案，而選擇答案的標準，似乎脫不了「（法）官大學問大」這麼句老話—最高法院說得比高等法院有道理，高等法院又比地方法院更知道法律問題的正確答案。 更高年級的法律系學子會發現，法學的世界裡也不純然是法官說了算，更不是職位越高，法學見解越正確；還有許多博大精深（高層次的狡辯？）的法學理論。有些學生會在重要的法哲學家 Ronald Dworkin. 確實，三段論邏輯是法學不可或缺的一部份。但法律問題有不同答案，正是因為三段論（乃至於邏輯）只是法學的「一部份&...願意接受上述論證的人，或許還是會擔心「法律A...馬總統要尊重的是這個&...
