European Patent System Specialist. 考完以後，我覺得自己大概是不會上了。總平均要60分，而且專業科目要50分，這兩個目標看來都很難啊。 我的考場在四樓，第一堂的到考率就相當的低，不到60%。好像報名費繳好玩的，大家讓考選部賺這個錢都不會心疼，考到最後一堂到考率進一步降到45%左右。 智慧財產局在規劃制度的時候，採用代理人，專利師，律師三軌並行制，有代理人資格的人應該不會再想花力氣去考專利師。代理人的執照在去年底大放送，要等代理人凋零，我想大概要再等30 40年吧，只有一些不在這個業界，又被補習班給所說「百萬年薪」給誘惑的人才會奮力準備這一次的考試。 很意外的沒看到專利要件的考題，我想應該是另外有考一科審查基準的關係所以題目圍繞著總則，專利權，實施，以及損害與賠償這幾節。我想未來還是會以這樣的基調來測驗考生。 何謂處分，與處分相關的考題一定會出的，還有救濟的程序也是一定會出的。專利行政與訴訟程序不就是這一些而已嗎。 訂閱： 文章 (Atom). EPO 與 USPTO 建立專利審查高速公路. 有許多的專利局已經相互交換審查資料了，比如說，美日澳韓加拿大。但是最大的兩個局，EPO與USPTO 並沒有這樣的合作機制。9月底EPO公布了與USPTO專利審查高速公路的合作方案。 有一篇文章，有詳細的說明與評論。簡單的說，EPO好像很不情願與USPTO交換審查資料，運用許多官僚的手段(red tape)增加申請人與兩局合作的成本。 我認為，台灣的申請人應該不會受惠於這個計畫，除非是以PCT方式申請的專利案件。 訂閱： 文章 (Atom). European Patent System Specialist. 2010 年起 台灣智慧財產局將開始逐項收費 - TIPO Will Collect Examining Fees by Numbers of Claims. 根據 台灣智慧財產局的公告- 「專利規費收費準則」部分條文修正案. 65292;台灣智慧財產局將在99年1月1號起，根據發明專利的申請項數逐項收取初審的實體審查費。 這項措施將自99年，也就是2010年的發明申請案開始實施，並且不溯及既往，也就是以申請日期來分。98年的申請案不論項數多少實體審查費，一律收8,000新台幣，99年開始的新申請案，就得要根據申請的項數來計算審查費。基本的項數是10項，收7,000元，每多1項，增加800元，所以說如果有案子要送，或是分割的，得趕快在98年12月31日送，否則那個多收的審查費會跟目前的數字差很多啊。 訂閱： 文章 (Atom). European Patent System Specialist. 原文連結: DSS case shows why EU leaders want one patent jurisdiction, but will patent owners? 這篇文章的內容主要說明 DSS目前在歐洲的訴訟狀況，以及衍生的問題。 DSS是一家美國公司，發明了一種鈔票防偽的技術，並且獲得了EPO准予專利。它認為歐洲央行發行的歐元鈔票，侵犯了它的專利權，控告歐洲央行，要求侵權的賠償。 DSS一開始先向盧森堡來訴訟，但是盧森堡以他沒有管轄權駁回，於是DSS到每個歐盟國家進行訴訟。同時歐洲央行也在數個歐盟會員國的國家法院提起專利無效的訴訟。 目前已經有幾個國家有初步的訴訟結果，在英國最高法院暫時停止高等法院撤銷專利的決定，法國也有類似的決定。但是在荷蘭與德國則是專利有效，DSS準備進行侵權的賠償訴訟。 訂閱： 文章 (Atom).
