2014 年 12 月 19 日. 在定義問題 二 中，我們提到法理學家哈特 H.L.A. Hart 認為，要解答法律與道德間關係的分析性問題，必須先解決的兩件事. 2 尋找判斷何謂 適當的對法律的定義 的判準 criteria. 事實上，這兩個例子，分別指向了不同的定義方式，2.a.是當代法理學界，由哈特所主張應用的語言哲學分析方法 題外話，哈特師承牛津日常語言學派大家奧斯丁 J.L. Austin，也繼承了Austin的哲學立場 ，2.b.某程度上是指一些傳統的、典型的定義方式，也就是本篇所要探討的重點所在，我稱它為簡單的定義方法，但這並不意指我認為這種定義方法是很簡單(easy)的，而是指simple，希望指出這種傳統方法具有的的常見、常用的特徵。 定義 某件事物，其目的基本上是要用以區分某個事物與另外其他的事物間的不同，如果有人說，定義就只是 用語的問題 ，這樣的說法毋寧把定義看的太簡單了。 關於簡單的定義方法，基本上包括了傳統的 種 跟 類 兩種方法，先來談談前者，舉一個例子，比方說定義 正方形. 1 澄清我們的語言使用 如何正確的使用 正方形 這個詞。 種 與 類 能夠定義法律嗎.
